Terms of Use (End Users) — RizBit Icons

These Terms of Use (“Terms”) govern your access to and use of the RizBit Icons web application (the “App”), available via rizbit.uk (the “Website”). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who we are

The App is operated by RizBit, a UK-based Developer & IT Freelancer (“we”, “us”, “our”). Contact: [email protected].

2. The App and what it does

RizBit Icons is an icon generation tool that allows you to create one or more square icons in multiple sizes and formats (such as PNG, JPG, and WebP) from a base image. The App runs on iOS, Android and in desktop and mobile browsers.

All image effects and icon generation features run locally in your browser. If you generate multiple icon sizes, the App may package outputs into a ZIP file for download.

AI modification requires us to upload your selected image to our server and is then sent to a third party AI API.

3. No account required

You do not need to create an account or log in to use the App.

4. Acceptable use

You agree that you will not use the App to:

  • Upload, generate, modify, or distribute unlawful, harmful, threatening, abusive, harassing, hateful, or defamatory content;
  • Create or distribute content that is obscene, sexually explicit, or otherwise inappropriate;
  • Infringe intellectual property rights (including copyright and trademark), privacy, or any other rights of others;
  • Generate or modify images depicting illegal activity or encouraging harm;
  • Attempt to reverse engineer, disrupt, overload, or interfere with the App, the Website, our servers, or any third-party services;
  • Bypass or attempt to bypass rate limits, usage controls, or security measures.

5. Your content and permissions

You are responsible for any images, logos, prompts, and other material you upload or submit (“User Content”). You represent and warrant that you own or have all necessary rights, permissions, and licences to use your User Content with the App and to create the outputs you download.

We do not pre-screen, review, or moderate User Content. If you use third-party images, logos, or brands, you are solely responsible for ensuring you have permission to use them and for complying with any licence terms.

6. AI features and third-party processing

The App offers optional AI features including image generation and image modification (inpainting) (“AI Features”). AI Features are provided via third-party services and require sending certain data off-device.

AI image generation / prompts: If you submit a text prompt, it may be sent to our server (via a PHP script) and then forwarded to a third-party AI provider (currently Pixazo) to produce the requested output. We may store your prompts on our server for upto 48 hours for purpose of preventing abuse, after this they are deleted.

AI modify image (inpainting): If you use AI modification, the image you select may be uploaded from your browser to our Cloudflare R2 storage to obtain a temporary image link. We then send that link (and any related prompt/instructions) to the third-party AI provider to perform the modification. Images stored in our Cloudflare R2 bucket are retained for a maximum of 24 hours and then automatically deleted.

Third-party services (including Pixazo and Cloudflare) have their own terms and policies. Your use of AI Features may also be subject to those third-party terms.

Quality: AI image generation and AI image modification features rely on third-party artificial intelligence services. While we strive to provide high-quality results, we cannot guarantee that generated or modified images will meet your expectations or match the exact intent of your prompt.

The results produced by AI systems may vary and depend on several factors, including but not limited to:

  • the clarity, detail, and wording of the prompt you provide

  • the content and quality of the source image (for image modification)

  • the behaviour and limitations of the underlying AI models

AI image modification works best for adding, altering, or enhancing elements within an image. Removing objects or producing precise edits may sometimes produce unexpected or imperfect results.

Each AI generation or modification request counts toward your usage limits, regardless of the outcome or whether the result meets your expectations.

To achieve better results, users are encouraged to experiment with and refine their prompts using widely accepted prompt-writing best practices.

7. Ownership of outputs and your licence to use them

As between you and us, you retain ownership of your User Content. The icon files and images you generate or modify using the App (including AI-generated outputs) are intended to be owned by you, and you may use them for personal or commercial purposes, subject to these Terms and any applicable third-party terms (including AI provider terms) and subject to third-party rights.

Important: If your User Content (e.g., a logo) or your outputs include third-party intellectual property, you are responsible for ensuring you have the rights to use that IP commercially or otherwise.

8. Advertising

The Mobile Apps may show our own non-personalised in house banner ads. 

The Website App may display advertising, including Google AdSense ads. Where required, you will be shown a consent management prompt (CMP) to manage ad-related consent choices. Advertising providers may collect data (including via cookies or similar technologies) according to their own policies and your consent choices.

9. Rate limiting and local storage

To protect the service and enforce limits on AI image generation / modification usage (as stated on the website), the App uses your browser’s localStorage to store a non-identifying rate-limit record under the key rizbit_modify_limits. This may include timestamps and counters (e.g., lastModifyTime, dailyCount, dailyResetDate).

The App may also store temporary session data in your browser memory (for example images, crop selections, effect settings, and generated icons). This temporary data is cleared when you close the tab/browser session.

10. Disclaimers (as-is) and no warranties

The App (including AI Features) is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties or representations of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, secure, or available at all times, or that outputs will meet your expectations or requirements.

AI outputs may be inaccurate, unexpected, or unsuitable. You are responsible for reviewing outputs before use, especially for branding, compliance, or commercial applications.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any loss or damage arising from or in connection with your use of (or inability to use) the App, including AI Features, advertising, or third-party services. This includes (without limitation) indirect or consequential losses, loss of profits, loss of business, loss of goodwill, loss of data, or business interruption.

We are not responsible for (i) the content you upload, generate, or modify, (ii) any intellectual property issues relating to your User Content or your outputs, or (iii) third-party outages, API failures, downtime, or delays (including Pixazo or Cloudflare).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, liability for death or personal injury caused by negligence, or fraud).

12. Indemnity

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the App; (c) your breach of these Terms; or (d) your infringement of any rights of any third party.

13. Suspension and termination

We may suspend or restrict access to the App (in whole or in part) at any time if we reasonably believe you have breached these Terms, attempted to bypass usage controls, or used the App unlawfully or abusively. We may also discontinue the App at any time.

14. Changes to the App or Terms

We may update the App and these Terms from time to time. The latest version will be posted on the Website. By continuing to use the App after changes take effect, you agree to the updated Terms.

15. Not intended for children

The App is not intended for children. If you are not old enough to consent to online services in your country, you should not use the App.

16. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. You agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the App, except where mandatory consumer protection laws in your country provide otherwise.
